With many starting to depart as of today on the holidays for the next couple of weeks thought I might get in with best wishes, so here they are:

Without Prejudice – A very Legal Christmas
All I wanted to say was "Merry Christmas and A Happy New Year"...

So, I ran it past my lawyer on the grounds that I don't want to upset
anybody in these politically correct times. His advice was that
such a terse, arbitrary and unqualified greeting left me open to a wide
variety of legal risks and instead suggested the following, which he claims
will protect my interest in this greeting and is consistent with National
and International law in all English-speaking geographies...

From me ("the wishor") to you ("the wishee"):

Please accept without obligation, implied or implicit, my best wishes for
an environmentally conscious, socially responsible, politically correct,
low stress, non-addictive, gender neutral, celebration of the summer/winter
solstice holiday (depending on your hemisphere of residence), practised
within the most enjoyable traditions of the religious persuasion of your
choice, or secular practices of your choice, with respect for the
religious/secular persuasions and/or traditions of others, including the
choice not to practice religious or secular traditions at all.

I wish you a financially successful, personally fulfilling and medically
uncomplicated recognition of the onset of the generally accepted calendar
year 2009, but with due respect for the calendars of choice of other
cultures or sects, and having regard to the race, creed, colour, age,
physical ability, religious faith, choice of computer platform, or sexual
preference of the wishee.

By accepting this greeting you are bound by these terms that:-

- This greeting may be subject to further clarification or withdrawal.

- These wishes are provided on an Open Source basis and, as such, the
wishor grants the wishee the full rights to use all, or any part of these
wishes, for the purpose of conveying wishes to others, so long as any
augmentation to the text of these wishes is made available on exactly the
same basis as they are tendered here and the rights of the original wishor
are acknowledged.

- This greeting implies no promise by the wishor to actually implement any
of the wishes, or upgrade such wishes at any future point.

- This greeting may not be enforceable in certain jurisdictions and/or the
restrictions herein may not be binding upon certain wishes in certain
jurisdictions and is revocable at the sole discretion of the wishor.

- This greeting is warranted to perform as reasonably may be expected
within the usual application of good tidings, for a period of one year or
until the issuance of a subsequent holiday greeting, whichever precedes the
other.

- The wishor warrants this greeting only for the limited replacement of
this wish or issuance of a new wish at the sole discretion of the wishor.

And by the way, MERRY CHRISTMAS AND A HAPPY NEW YEAR, or HAPPY HOLIDAY SEASON or whatever, to you all :)

wa55: That can't be legalese! There are commas in the text ;) Having read my mortgage document (once), I found that it could not be read aloud without pausing for breath. And, of course, pausing could change the context of what was written. Legal dilemma?

Best wishes to all for the festive season.

here's hoping for a few 'bytes' to eat, as I like to 'nibble' on sweeties at Christmas
